As an internet service provider, we are protected under the “safe harbor” provisions of the DMCA, which allows us immunity from infringement claims.

Notice of Infringement – Claim

  1. A signature from the copyright owner or their authorized representative.
  2. Clear identification of the copyrighted work that has been infringed.
  3. Details pointing to the infringing material for removal, along with information for locating the material efficiently (such as the URL).
  4. Contact information for the complaining party, including name, address, email, phone number, and fax number.
  5. A statement from the complaining party that they believe the material is being used without authorization from the copyright owner.
  6. A statement confirming the accuracy of the information provided and declaring under penalty of perjury that the complaining party is authorized to act on behalf of the copyright owner.

Section 17 USC §512(f) outlines penalties for knowingly misrepresenting information in a copyright infringement notification under section 17 USC §512(c)(3), including costs and attorney fees.

Counter Notification – Restoration of Material

If you receive a notice of takedown due to a copyright infringement claim, you can provide a counter notification to request the material’s restoration. The counter notification must be in writing to our DMCA Agent and include specific elements outlined in Section 17 USC §512(g)(3).

  1. Your signature.
  2. Description of the removed material and its original location.
  3. A statement under penalty of perjury asserting that the material was removed or disabled due to mistake or misidentification.
  4. Your name, address, telephone number, and a statement consenting to the jurisdiction of the federal district court.

Repeat Infringer Policy
